As per the norms and standards of the RTE Act, there must be at least three teachers for number of children between 60-90 in the school" - stated Mr Paritosh Chakma. </span></p><p><span style="font-size: large;">It is pertinent to stress here that the right to free and compulsory elementary education is a Fundamental Right under Article 21A of the Constitution of India which states, “21A. The State shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine.”</span></p><p><span style="font-size: large;">"As fundamental rights cannot be taken away under any circumstances and since education is a top priority of the state government, I urge the Mizoram Education Department to immediately appoint adequate number of teachers at Govt PS at Bandiasora village under Hmundo village council in Lunglei District as per the norms and standards of the RTE Act", Mr Paritosh Chakma demanded in his petition to the Mizoram Education Department. Mrs. Esther Lal Ruatkimi, Commissioner & Secretary and (2). Mr. James Lalrinchhana, Director, Directorate of School Education, Government of Mizoram, asking them to appoint adequate number of teachers at Government Primary School at Samuksury Chakma village in Lunglei District of Mizoram. This government school is running with only one teacher for several years. The lone teacher teaches 80 students from Class I to IV. He has to teach all subjects, from maths to English to social sciences! This is not humanly possible.<br /><br />When this lone teacher takes a particular class, the students of the other three classes have to simply sit idle or they make noise.</span></p><p><span style="font-size: medium;">"How can a single teacher teach 80 students of four different classes? This is a total violation of the fundamental right to free and compulsory education upto elementary level guaranteed by the Constitution of India and the Right to Education Act. belonging to the community cannot get enrolled in the voter list every year.
Obviously, there are hundreds of Chakmas who were not issued Voter IDs and do
not have one. The notification by the health department is part of the
continuing discrimination against the minority Chakmas, Paritosh alleged.<o:p></o:p></span></div>

Chakmas belong to Tibeto-Mongoloid race, just like the Mizos and majority
tribes of the Northeast, but speak a language which is Indo-European. They are
one the rarest tribal groups having their own script called Ajha Path which has
been found to be closely linked to the Burmese scripts. The community is
divided into 46 gozas (clans). <o:p></o:p></span></div>

history of the Chakmas is obscure. They are the descendents of the Sakya race
to which Lord Buddha belonged. Some centuries before Lord Buddha was born, a
Sakya king/prince named Abhi Raja had left Kapilavastu on the foothills of the
Himalayas (in present-day Nepal) and founded the Tagaung kingdom, the first
Burmese kingdom, on the banks of Irrawaddy in Upper Burma. Burmese histories
namely Maha Rajaweng (or, Great History of Kings) and The Glass Palace
Chronicle of the Kings of Burma confirm the arrival of this Sakya king/prince
from Kapilavastu. The Burmese chronicles handed down names of three original
tribes namely Kanran, Pyu or Pru, and Sak or Thek. Sir Arthur P. Phayre, former
Chief Commissioner of British Burma and authority on the Burmese history,
opined that “The last [Sak/Thek], however, is not an original native term, but
probably an abbreviation of Sakya, and may have been retained by at least a
portion of the earliest Indian settlers and their descendants for some time”. A
few centuries later and a few years before the death of Lord Buddha, another
migration of Sakyas to Burma occurred, this time under the leadership of prince
Daza Raja. Both these two great migrations happened because of murderous
attacks on Kapilavastu by the ruler of Kosala, a powerful kingdom in north
India. Sakyas’ pride which did not allow to marry off their pure-blood women
outside the community was responsible for these attacks on them. The second
attack had brought near total annihilation of the Sakyas as Kosala king
Virudabha had ordered massacre of every Sakya including infants to avenge
deceit committed by the Sakyas upon his father, Pasenadi or Prasenajit. King
Prasenajit wanted to marry a Sakya princess but the notorious Sakyas thought it
beneath their dignity to marry off a pure-blooded Sakya princess to anybody
outside their clan. Therefore, Sakya raja Mahanama, a cousin of the Buddha,
deceitfully sent his illegitimate daughter Vasabha, born from a slave-woman
called Nagamunda, whom king Prasenajit married and Queen Vasabha gave birth to
a son named Virudabha. Sir Phayre claimed that the modern Burma race are
descendants of Sakyas who had migrated to the valley of Irrawaddy from
Kapilavastu.<o:p></o:p></span></div>

to Pamela Gutman, the Saks ruled the Central Burma in the 9th century while the
Burmans (Mranma) ruled the plains. The Saks were a powerful and fearful nation

period of migration of the Saks, who came to be known as Chakma in modern
sense, to their present territory in the Chittagong Hill Tracts (CHT) and
adjoining parts of Mizoram is not accurately known. But their Arakanese roots
are beyond any doubt. All modern historians-scholars tend to agree that at some
point of time the Chakmas had lived in Arakan where they are still known as
“Daingnets”. Captain TH Lewin stated, “Whatever opinion may be formed of the
primal origin of the Thek, or Chukma tribe, no doubt can exist as to their
having been at one time inhabitants of the province of Arracan, from whence
they have migrated to these hills (Chittagong Hill Tracts).” H.H.S. Hutchinson
held that “The Chakmas are undoubtedly of Arakanese origin.<span style="mso-spacerun: yes;"> </span>They immigrated into the Chittagong District
where they intermarried largely with the Bengalis, whose language they speak.”
According to H.H. Risley, “The evidence at present available does not appear to
warrant any more definite conclusion than that the Chakmas are probably a
people of Arakanese origin, whose physical type has been to some extent
modified by intermarriage with Bengali settlers.” Satish Chandra also held the
opinion that “That at one point of time they had lived in the Arakan there is
no doubt about it. They have been using the scripts imitated (from Arakanese)
since then.” Dr Francis Buchanan and B.H. Hodgson also called the Thek (Chakma)
“aboriginal” of Arakan.<o:p></o:p></span></div>

Saks (also spelt as Tsak) were also known to the Burmese as “Thet” or “Thek” as
the Burmese sometimes pronounced “S” as “Th”. The name “Chakma” is a modern
appellation of the tribe name “Sak”. As Lewin stated, “The names of Chukma,
Tsak, Thek, and Doingnak, may all therefore be taken as names representing the
(Chakma) tribe”. Risley also identified the Chakma as Tsakma, Tsak, and Thek.
In 1798, Dr Buchanan stated that “the Sak are the same people with those, who
in the Northern parts of the province are called Sakma, or Chakmas.” Dr
Buchanan further mentioned, “They call themselves Saksa, which word corrupted
has, I suppose, given rise to their Bengalese name Sagma or Chakma.”<o:p></o:p></span></div>

Burmese, “tha” or “tsa” means “son”. Therefore, the literal translation of
“Saksa” would be “son of Sak”. Since “Chakma” has been derived from “Saksa”,
the accurate meaning of “CHAKMA” is “CHILDREN OF SAKYA”. Or, in other words,
they are the descendants of the Sakya tribe to which Lord Buddha himself
belonged. Chakmas still call themselves “Sakma” or “Sangma”.<o:p></o:p></span></div>

<span style="font-family: "times new roman" , "serif"; font-size: 13.0pt;">Sadly,
the Chakmas do not have a written history. They, however, have carried an oral
tradition till today which claims that they are the descendents of Sakya who
had ruled a legendary kingdom called “Champaknagar” whose location has yet to
be accurately identified. Oral traditions of Chakmas say a prince of
Champaknagar named Bijoygiri marched southwards to conquer parts of Chittagong
and Arakan with the help of his military commander Radhaman. When he decided to
return home after the victorious expedition, news about the death of his aged
father and usurpation of the throne by his younger brother Samargiri reached
him. Prince Bijoygiri was against the idea of bowing down to his younger
sibling who was now the king, and hence decided to settle in the conquered land
with his army. Bijoygiri had snapped all the communications with Champaknagar
and its people who sank into the oblivion and the modern Chakmas are believed
to be the descendants of Bijoygiri and his dewans (chiefs). In 1909, Hutchinson
termed the Bijoygiri story as “a myth” but Risley had opined in 1892 that
Bijoygiri had invaded the Chittagong Hill Tracts (CHT) about the end of the
14th century. The Chakmas strongly believe that Demagiri (now in Mizoram)
abutting the hills of CHT was founded by Chakma prince Bijoygiri.<o:p></o:p></span></div>

Petition filed by the Government of Mizoram against the judgment of the Guahati
High Court in PIL No. 49/2016 (popularly known as “STEE Case”) in the <i style="mso-bidi-font-style: normal;">Mizoram Chakma Students Union Vs State of
Mizoram</i>.</span><span lang="EN-IN" style="font-size: 13.0pt; mso-ansi-language: EN-IN;"><o:p></o:p></span></div>

a Supreme Court bench headed by Justice S A Bobde observed that the judgment of
the Guahati High Court dated 22.2.2019 in PIL No. 49/2016 was such a
well-reasoned judgment that it required no interference and dismissed the <span style="mso-bidi-font-weight: bold;">SLP(C) No. 014537/2019 filed by the </span>Mizoram
Government.<o:p></o:p></span></div>

22.2.2019, the Gauhati High Court quashed the Mizoram (Selection of Candidates for
Higher Technical Courses) Rules, 2016 notified in the gazette on 22.04.2016
which put the “Zo-ethnic people” (Mizos) under Category-I and “non-Zo ethnic
people” under Category-II and further reserved 95% seats for Category I, 4%
seats for Category II and 1% seats for Category-III (Children of non-permanent
residents of Mizoram). The Mizoram Chakma Students’ Union (MCSU) challenged the
constitutional validity of this Rule. <o:p></o:p></span></div>

Hindu</i> titled "Change in Mizoram" which was about the recent election outcome in the Northeastern state of Mizoram. </span></div>

<span style="font-family: "Times New Roman","serif"; font-size: 13.0pt;">The editorial had a line "</span><span style="font-family: "Times New Roman", serif; font-size: 17.3333px;">The BJP managed to mark its first and only victory in the State by winning the Chakma <i>refugee</i>-dominated Tuichawng seat in south Mizoram’s Lawngtlai district." (italics are mine)</span></div>

<span style="font-family: Times New Roman, serif;"><span style="font-size: 13pt;">Referring the indigenous Chakma tribe as "refugee" was a shocker for every educated person who is </span><span style="font-size: 17.3333px;">acquainted</span><span style="font-size: 13pt;"> with Mizoram and one who respects <i>The Hindu</i> as one of the most credible media institutions. Because, Chakmas are Scheduled Tribes in Mizoram and for the protection of their distinct ethnicity, three minority groups were given political autonomy in the form of Autonomous District Council established under Sixth Schedule to the Constitution of India. These three ethnic communities are Chakma, Mara and Lai. Chakma Autonomous District Council (CADC) was established under the Constitution of India in 1972, together with the Mara and Lai.</span></span></div>

How come a tribe who have constitutional status and protection be refugees? So, </span><span style="font-family: "Times New Roman", serif; font-size: 13pt;">how can <i>The Hindu</i> err so much? Calling the Chakmas of Mizoram as "refugees" is an assault on their dignity as citizens of India.</span></div>

Chakma Buddhist Society (CBS) has organised Bizu Miloni programme in
partnership with Gandhi Smriti and Darshan Samiti (GSDS), an autonomous body
under the Ministry of Culture, Government of India. The programme was held on
13th April 2017 on the auspicious occasion of Phul Bizu at Satya Graha Mandap
in the premises of Gandhi Darshan at Rajghat, New Delhi.</span><o:p></o:p></div>

Scheme (CSS) in Mizoram have once again gathered at a place in the heart of Aizawl and launched another round of indefinite hunger strike from the
midnight of 22 March 2017 demanding regularization of their jobs. A total of 1305 CSS Hindi teachers
have not been paid their salaries for the last 10 months i.e. upto February 2017 when their employment contracts expired. </span></div>

(MCHTA), has claimed that at least 17 Hindi teachers have died in the last several months due
to their inability to afford treatment due to non-payment of salaries. The
MCHTA has put up a list of 15 of their deceased colleagues on the wall of the
CM's Bungalow.</span></div>

teachers are being attended by doctors after their health deteriorated
for not taking food. At least six teachers have been hospitalized and a
pregnant lady has reportedly suffered miscarriage during the protest fasting.</span></div>

of Chakmas, today urged the Union home ministry to conduct an impartial inquiry
into the "custodial killing" of Kamal Mitra Chakma, a rifleman of 36
Assam Rifles posted at Jalaki in Nagaland.<o:p></o:p></span></div>

a statement today, Victor Talukdar, deputy secretary-general of the forum,

March 10. He was thrown outside the premises assuming that he was dead. Some
people spotted him and handed him over to the Assam Rifles authorities who
admitted him to Jorhat military hospital in Assam in a serious condition. He
died today.<o:p></o:p></span></div>

told us that Chakma told them that he was beaten up by his colleagues,"

“indefinite hunger strike” in the heart of Aizawl, capital city of Mizoram demanding immediate release of their pending 10 months' salaries and regularization of their jobs which have effectively
expired today (28<sup>th</sup> February 2017). A total of 1305 Hindi CSS teachers recruited under “Scheme of Financial
Assistance for Appointment and Training of Hindi Teachers in Non-Hindi Speaking
States/UTs”, under which Central government pays the salaries, are uncertain
about their future. Their jobs are hanging in balance because the scheme’s guidelines state that after the Plan
year (currently, 12<sup>th</sup> Five Year Plan, 2012-17) the responsibility of
maintenance of these Hindi teachers “<i>shall
rest upon the concerned State Governments/UT Administrations. They will be
required to discharge this responsibility out of their own resources in their
budget.”<o:p></o:p></i></span></div>

the matter worst, the Central government apparently has appointed recently a
private institution Awadh Research Foundation based in Lucknow to evaluate the
need of the scheme in Mizoram and any further decision will be based on
the recommendations of this research institute.</span></span></div>

Teachers Association members have been forced to resort to “Pen Down Strike”, which included boycott of classes and annual exam, and took to the streets of Aizawl demanding just decisions from the governments, i.e. to regularize/extend their services, and payment of their salaries. Left with no other option, they
launched indefinite hunger strike in front of the Chief Minister’s office cum residence from yesterday.<o:p></o:p></span></div>

Human Resources Development has not released their salaries, as no official
statement in this regard has been issued by the Ministry. It is also not clear
as to why the evaluation of the scheme was not done much earlier, say in 2016,
which could have avoided the situation of uncertainty and chaos as we are
seeing today.<o:p></o:p></span></div>

fact that it is not the CSS Hindi teachers alone who have not been paid for months. Almost
2,200 Sarva Shiksha Abhiyan (SSA) teachers (which is also a Centrally Sponsored
Scheme) across Mizoram have not been paid their monthly salaries since August
2016, as per a report by <i>The Frontier
Despatch,</i> a local English weekly, dated 19<sup>th</sup> January 2017. These

Hindi can ensure better communications between ethnic communities, ensure social progress, national integration and boost tourism in the state. Hindi can be a tool for empowerment to the population of the state by eradicating feeling of alienation
from the <i>mainstream</i>, which is strong
among the people of Mizoram, and help the ethnic communities linguistically when they are living outside
the state (particularly North India, Hindi belt) for education, jobs and
businesses etc and within the state. <o:p></o:p></span></div>

must continue the “Scheme of Financial Assistance for Appointment and Training
of Hindi Teachers in Non-Hindi Speaking States/UTs” in Mizoram and extend the employment of these 1305 Hindi teachers without lose of time. <o:p></o:p></span></div>

<span style="font-family: "times new roman" , serif; font-size: 13pt;">Demagiri, or Tlabung, in Western Mizoram near to the India-Bangladesh border, is a British era village (now a sub town). The British had set up their foremost frontier post here during the Lushai Expedition in 1871-72 and finally annexed the Lushai hills in 1890s. Demagiri was the gateway of British conquest of Lushai hills (present day Mizoram) and Lt Col TH Lewin had set up his headquarters here. The British came to conquer Lushai hills through the Karnafuli river, also known to Chakmas as Borgang, over which the mighty Kaptai Dam was built by the East Pakistan government in 1960s. </span></div>
<div class="MsoNoSpacing" style="text-align: justify;">
<span style="font-family: "times new roman" , serif; font-size: 13pt;"><br /></span>
<span style="font-family: "times new roman", serif; font-size: 13pt;">Tragically, as of date there is no bridge over the Karnafuli river. The river which has swollen due to the Kaptai Dam waters, divides Indian villages and as many as 17 Indian villages, predominantly inhabited by Chakma tribal people, are on the other side of the river (bordering Bangladesh). An estimate stated that around 7,000 people live on the other side of the
Karnafuli river. </span><br />
<span style="font-family: "times new roman", serif; font-size: 13pt;"><br /></span>
<span style="font-family: "times new roman", serif; font-size: 13pt;">The villages which are situated on the
other side of the Karnafuli river are (1) Nunsury I, (2) Nunsury II, (3)
Bindiasora, (4) Tablabagh I, (5) Tablabagh II, (6) Tablabagh III, (7) Kalapani,
(8) Lokkisury, (9) Malsury, (10) Devasora, (11) Puankhai, (12) Nakruksora, (13)
Bandiasora, (14) New Balukiasuri, (15) Saichen, (16) Hmundo and (17) Mauzam.</span></div>

<span style="font-family: "times new roman" , "serif"; font-size: 13pt;">Every day, dozens of tribal school children from the other side of the river put their lives at risk while crossing the fearful river of Karnafuli by small boats to come to schools at Demagiri (Tlabung) which is on the opposite side of the river (Indian side). (See </span><span style="font-family: "times new roman", serif; font-size: 17.3333px;">the photograph of school children dangerously crossing the Karnafuli river by small boat at the risk of their lives while going to school.)</span></div>

<span style="font-family: "times new roman", serif; font-size: 13pt;">The only civil hospital is also situated at Demagiri which is inaccessible to the border people living on the other side of the river. In the absence of a bridge over the Karnafuli river, the villagers are forced to take motor boats which are quite expensive for the impoverished villagers. Lack of ability to pay the ferry charges directly result in denial of access to markets, banking and post office, schools, and communication facilities etc.</span></div>

Karnafuli river, the border inhabitants of these villages shall be uplifted not
only economically in terms of access to markets and business but also in terms
of access to education, health services, and other social welfare facilities. </span></span><br />

<span style="font-family: "times new roman", serif; font-size: 13pt;">Above all, a bridge over the Karnafuli river will restore freedom of movement of
these Indian citizens within their country from which they have been tragically
deprived in independent India.</span><br />

<span style="font-family: "times new roman", serif; font-size: 13pt;">Therefore, the Government of India/Government of Mizoram should take urgent measures to build a bridge over the Karnafuli river at Demagiri.</span><br />

Higher Technical Courses) Rules, 2016 reserve 95% seats for Category I
(Zo-ethnic people) while giving only 4% seats to Category II (Non-Zo ethnic
people including Chakmas who are scheduled tribes and more backward than the
Mizos) and 1% to children of Central government employees posted in Mizoram.
Further, the State Medical and Technical Entrance Examination Information
Brochure 2016” provides that Category I candidates (Mizos) will get first
priority to take the seats/colleges and only the left out seat, if any, will be
given to Category II candidates i.e. Chakmas and other non Mizo scheduled Tribes.

Department has declared the allotment of seats but it is found that not a
single seat in Engineering or MBBS has been allotted to Category II. This means

would not get any MBBS or Engineering college despite being Scheduled Tribes

Students Union (MCSU) had filed a PIL (no. 39/2015) in Guwahati High Court
challenging the Mizoram (Selection of Candidates for Higher Technical Courses)
(Sixth Amendment) Rules of 2015 by dividing the Scheduled Tribes into
indigenous i.e. Mizos and non indigenous (non-Mizo scheduled tribes) and
reserving all the seats for the indigenous ethnic Zos. On 16 July 2015, the
Guwahati High Court disposed of the PIL after the Mizoram government withdrew
the Sixth Amendment Rules of 2015 and put the Chakmas under Category I

The Guwahati High Court today stayed the controversial higher and technical education rules, titled <i>Mizoram (Selection
of Candidates for Higher Technical Courses) (Sixth Amendment) Rules, 2015</i>,
which was notified on 24 March this year amidst high drama. The 1999 principal Rules was amended
after the Mizo Zirlai Pawl (Mizo Students body) protested against the selection
of 38 Chakma students under Category I along with Mizo students for study of medical
and engineering courses in colleges across the country under Mizoram quota.</div>

The controversial 2015 Rules changed the definition of Category I to
include only “indigenous” Zo people. Chakmas are placed under Category II which
is for non-Zo. The Chakmas vehemently protested against this discrimination on
the basis of race.</div>

The Mizoram Chakma Students Union filed a writ petition in
the Guwahati High Court against the Mizoram government’s illegal 2015 Rules and
secured a stay order today.</div>

The Guwahati High Court’s stay order is a significant
development for Mizoram’s beleaguered minorities. In this long battle for rights and
justice, the first round has gone to the Chakma students. </div>

affected by so called developmental projects are shabbily treated in this
country, the Papumpare Chakma Welfare Society has brought to the public notice
that 237 Chakma families face imminent displacement due to acquisition of the
lands for the proposed Itanagar Greenfield Airport at Hollongi in Papumpare
district of Arunachal Pradesh.<o:p></o:p></span></div>

affected people and there is no transparency in the proposed acquisition of the

villages (Chakma Blocks No. 2, 3, 5, 6 and 10) have been demarcated as proposed
airport site by the magistrate/ extra assistant commissioner (EAC) Balijan
Circle under the direction from the state government. But neither the
government of Arunachal Pradesh nor the Airport Authority of India (AAI) has
informed anything officially to the affected people regarding the acquisition
of their lands. Chakmas do not know where the displaced people will be
resettled, the PCWS stated in a press statement.<o:p></o:p></span></div>

settlement area' where Chakmas from the then East Pakistan, now Bangladesh, had
been settled by the government of India in consultation with the then local
administration during 1964-69. “If the Chakmas lose their allotted lands, they
stand to lose everything. In the absence of any other livelihood options as
well as any government support, agriculture is the only means of survival for
them,” stated Bodhisatta Chakma, President, PWCS.<o:p></o:p></span></div>
